Welcome to Apex Gear ("we," "our," "us"). By using our website and purchasing our products, you agree to these Terms of Service. Please read them carefully before making a purchase or using any of our services.
2. Products
We sell gaming peripherals including but not limited to mice, keyboards, headsets, mousepads, controllers, and related accessories. Product specifications, images, and descriptions are provided for informational purposes. While we strive for accuracy, slight variations may occur between product images and the actual product due to manufacturing differences and monitor calibration.
3. Pricing & Payment
All prices are listed in US Dollars (USD) unless otherwise noted. Prices are subject to change without notice, but changes will not affect orders that have already been placed and confirmed. We accept major credit cards (Visa, Mastercard, American Express, Discover), PayPal, and other payment methods as displayed at checkout. Payment is due in full at the time of purchase. Sales tax will be applied where required by law.
4. Orders & Acceptance
Placing an item in your cart does not constitute an order or guarantee availability. Your order is confirmed when you receive an order confirmation email from us. We reserve the right to cancel or refuse any order for any reason, including but not limited to: suspected fraud, incorrect pricing, stock unavailability, or violation of these terms.
5. Shipping & Delivery
We ship to addresses within the United States and select international destinations. Shipping times are estimates and not guaranteed. We are not responsible for delays caused by shipping carriers, customs processing, or force majeure events. Risk of loss passes to you upon delivery to the carrier. Signature may be required for orders over $250.
6. Returns & Refunds
Our Return & Refund Policy is available on our dedicated refund policy page and is incorporated into these Terms by reference. We stand behind our products and offer returns within 30 days of delivery for most items.
7. Warranty
All Apex Gear products come with a limited warranty against manufacturing defects. Standard warranty periods: Mice & Keyboards — 2 years; Headsets & Controllers — 1 year; Mousepads & Accessories — 6 months. The warranty does not cover damage from misuse, modification, liquid damage, or normal wear and tear. For warranty claims, please contact our support team.
8. Intellectual Property
All content on this website — including logos, product designs, images, text, and trademarks — is the property of Apex Gear or our licensors. You may not reproduce, distribute, or create derivative works without our express written permission.
9. Limitation of Liability
To the maximum extent permitted by law, Apex Gear shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our products or website, including but not limited to lost profits, data loss, or personal injury. Our total liability for any claim shall not exceed the purchase price of the product giving rise to the claim.
